What gets divided
Matrimonial assets typically include the family home, other property, pensions built during marriage, savings, investments and sometimes business interests. Pre-marital assets and inheritances may be ring-fenced but can be invaded if needs require.
Debts are part of the picture — mortgage, loans and credit cards in joint or sole names affect net settlement.
Full financial disclosure (Form E) is mandatory in court proceedings — hiding assets can lead to set-aside orders later.
Pensions and the family home
Pensions are often the second-largest asset after property. Options include pension sharing (a percentage moves to the other spouse), offsetting (one keeps more house, the other keeps pension) or attachment orders (percentage of future payments).
The family home may be sold with proceeds split, transferred to one spouse with buy-out, or occupation orders for children until 18.
